Willy Sun Pleads Guilty To Smuggling Nvidia Chips To China

Export controls rest on paperwork the seller vouches for, checked by the seller's own compliance team, with a government spot-check after shipment. Per the indictment, every company-run check was beaten, by a friendly auditor, falsified leases and staged dummy servers. The scheme was caught when Commerce went and looked.

Ting-Wei 'Willy' Sun pleaded guilty on October 8 in Manhattan federal court to four conspiracy counts, including export-control violations and obstruction, in an alleged scheme that routed U.S.-built Super Micro servers with Nvidia chips through a Southeast Asian front to China; co-defendants Wally Liaw and Steven Chang are unconvicted, and Super Micro is not charged.

Why it matters: These servers are restricted for national-security reasons; the payments moved through New York banks; the company at the center is publicly traded and lost about a third of its value the day the charges came out. Meanwhile H200 chips became licensable to China in December 2025, while B200s remain barred.

Date to watch: October 20, 2026: the government's response to Liaw's pretrial motions is due (reply November 3); Sun's sentencing date not yet reported.
